Merchant terms

Purpose

These terms govern a shop's use of Dibs. By creating a merchant account you accept them. Dibs is a pre-order tool: the sale is concluded directly between you and your customer. Dibs is not a seller, not a courier and not a payment intermediary.

Allergens and product composition

You are solely responsible for the accuracy of the information you publish about your products: name, ingredients, allergens, diets (vegetarian, vegan, halal, gluten free) and nutritional values. As a food business operator within the meaning of Regulation (EU) No 1169/2011, this obligation rests with you and cannot be transferred to Dibs, which merely displays the information you enter. You undertake to keep it up to date whenever a recipe, supplier or process changes, and to flag any risk of cross-contamination. A "gluten free", "vegan" or "halal" claim may only be published if it is accurate across the whole chain, including preparation and packaging.

Indemnity

You indemnify Dibs against any claim, complaint, proceedings or judgment, and against the associated defence costs, arising from inaccurate, incomplete or out-of-date information you have published, in particular regarding allergens, or from a breach of the food or hygiene regulations applicable to you.

Orders and slots

You undertake to prepare accepted orders for the slot chosen by the customer, or to cancel them without delay if you cannot fulfil them. You keep your catalogue current: a product that has run out must be marked sold out, which removes it from the customer's view immediately.

Prices and collection of payment

The prices shown on Dibs are the ones you charge in your shop. You may not charge the customer a surcharge for using Dibs or for the means of payment, in accordance with Belgian and EU law. Payment is collected under your own payment contract: Dibs never holds the proceeds of your sales.

Subscription

Access to Dibs is billed as a subscription, with no commission on your sales. The price, term and billing arrangements are those agreed when you sign up. Unless agreed otherwise, either party may terminate the subscription on one month's notice.

Data

You remain the owner of your shop and catalogue data, and can export it at any time. The processing of your customers' personal data is described in our privacy policy.

Suspension

Dibs may suspend an account for a serious breach of these terms, in particular knowingly inaccurate allergen information, orders repeatedly accepted and then not prepared, or fraudulent use of the service.

Governing law

Belgian law. Any dispute falls to the competent courts of Brussels.
